Standard of Care and Medical Malpractice

by ynhh-healthlibrary on February 16th, 2012 at 2:20 pm
Posted In: Medical Conditions Index Continued, Brain Injury

The medical industry is rife with vulnerability to mistakes. An inherently imperfect endeavor, the practice of medicine leaves doctors, nurses, surgeons and other professionals open to making a mistake that can result in serious injury.

Fault is an essential element of any medical malpractice claim. The fact is, accidents happen in hospitals, nursing homes, clinics and other medical facilities every day. Proving the accident occurred as a result of medical negligence is the crux of a medical malpractice claim.

Part of establishing negligence is determining whether the doctor (or other health professional) acted in a way that deviated from accepted standards of the medical community. Even when acting reasonably and with competence, doctors and other healthcare workers can make a mistake. When arising during the normal course of competent healthcare, an honest mistake may not be grounds for a medical malpractice claim; however, the Miami medical malpractice attorneys at The Cochran Firm South Florida can determine whether your injury was caused by a deviation from accepted standards of care.

Expert testimony is often used to prove someone failed to meet a standard of care. This expert may be a doctor with similar qualifications to the doctor accused of malpractice. The expert must demonstrate how a reasonable, competent professional would act in the same circumstances, and also show how the negligent professional deviated from this standard. If your healthcare provider acted negligently and carelessly, you may be able to pursue compensation for your injury-related expenses.

Traumatic Brain Injuries: an Overview of Treatments

by ynhh-healthlibrary on October 12th, 2011 at 9:54 pm
Posted In: Medical Conditions Index Continued, Brain Injury

Traumatic brain injuries (TBIs) are devastating to the victims of these injuries. Accidents are a common cause, particularly those caused by a negligent party. These accidents happen very often in cities such as Sacramento, San Jose, and Ventura. As common as they are, the injuries, their diagnosis, and treatment aren’t often as familiar. It is important to know some of the treatments of traumatic brain injuries in order to understand their seriousness and the impact they have on a victim’s life.

In the first moments of treatment of potential traumatic brain injuries, evaluation of the victim occurs, and stabilization is the goal. This evaluation should always be done in a hospital setting, not left to first responders in an accident. Evaluation of traumatic brain injuries often involves neurology teams, traumatic surgery teams, and other trauma-related emergency personnel. Often psychologists with TBI knowledge will also be involved. Imaging may be done to determine the exact locations and natures of the injuries. The teams will do their best to minimalize damage as well as intracranial pressure. Sometimes this includes putting the victim into a drug-induced coma. At other times, special medications to prevent seizures may be used.

After the initial, acute stage of the traumatic brain injuries occurs, the patient is monitored by the hospital stuff and specialists. Continued surgeries may be necessary. After the initial dangers have passed, the patient may be transferred into rehabilitative care. In that center, the patient continues to receive specialized care. Stability is maintained while rehabilitation and healing is pursued. Rehabilitation attempts to restore some of the functions that were lost as the brain was damaged. Often, the patient has to be taught how to do things that were previously taken for granted such as speaking, eating, moving, and other skills that are required for living independently.

Long-term, the traumatic brain injury treatments will help the patient to hopefully recover what they can of lost functions and abilities. If not, long-term treatment and care must address secondary issues caused by the traumatic brain injuries such as other illnesses, other brain diseases, atrophy, psychological issues, and coping.

If you or your loved one is the victim of an accident that has or may have resulted in traumatic brain injuries, you are not without help; a personal injury attorney can help you get repayment for the costs of these injuries as well as helping to facilitate immediate, critical testing and care.

If you suffered a traumatic injury by no fault of your own, I recommend you contact Los Angeles personal injury attorneys if you live in LA. Here is a good firm we found online while surfing Google at 633 West Fifth Street, 28th Floor, Los Angeles, CA 90071. 213.596.9642.

Abuse or Neglect of the Elderly in Long Beach

by ynhh-healthlibrary on August 22nd, 2011 at 10:58 am
Posted In: Nursing Care

Every person who finds themselves in a situation where they can no longer care for themselves deserves to be treated with respect and care to maintain their quality of health. With a growing population of elderly people in Long Beach, this issue becomes more important each year. Sadly, over 2 million elderly Americans are subjected to abuse and neglect each year, whether physical, psychological, or otherwise.

Long Beach is not immune to the problem and it is important both to the patient and their loved ones that the facts of elderly abuse and neglect within a facility or otherwise be known ahead of time so that it can be avoided if possible, and remedied once it happens. When your elderly loved one is in the care of a facility or caretaker, you trust their very life with this person or home.

Rather than doing so blindly, be mindful of some of the signs that indicate possible abuse or neglect. If the abuse is psychological, the elder may first show it through changes in their normal behavior. Someone who is normally outgoing may suddenly become very introverted. Arguments may increase between the caretaker and the elderly person. If the neglect or abuse is physical, there may be signs such as a supposed failure to take medications regularly, a general increase in ailments, or even physical signs such as bruises, sores, or marks on the wrists and ankles.

Sometimes either the psychological or physical signs of elder abuse are explained as the effects of increasing age or illness; as the elderly are already fragile, this becomes a common excuse to hide neglect and abuse. However, abuse and neglect can be difficult to prove. If you suspect that your loved one may be the victim of abuse or neglect, it is vital that you contact a lawyer at Ehline Law Firm PC 6700 East Pacific Coast Highway Suite 275, Long Beach, CA 90803 (562) 342-9092, who specializes in the welfare of the elderly in the Long Beach area for problems like medical liens, so that they can advise you on what steps to take to ascertain your loved one is receiving the care that they should be.

When you trust your elderly loved one to someone else’s care, and they fail you, make sure you have a qualified elder abuse attorney on you and your love one’s side. Check out the Journal of Accident Emergency Medicine for Personal Injury Victims so you can understand more about your legal rights.

Collisions Between Cars and Trucks Result in Severe Injuries in Redondo Beach

by ynhh-healthlibrary on June 6th, 2011 at 4:29 am
Posted In: Accident Injury Recovery

Collisions between cars and trucks result in severe injuries in Redondo Beach, since there is a huge weight difference, then combine that with speed and the injuries are understandable. What is not understandable is how these collisions sometimes occur due to circumstances that might have been avoided. This is because not all trucks have drivers that are alert, or that have the experience necessary to drive one of these multi ton vehicles. Then there is the fact that not all truck companies provide the necessary maintenance and this includes brakes and tires. That will mean that the vehicle in this trucks path could be in danger of being involved in a collision.

The sheer weight of a truck makes it a hazard when it comes in contact with a vehicle and that means serious injuries. The injuries that can be sustained in a collision between a truck and car include traumatic head injuries, major back and neck injuries, broken bones, internal injuries, gashes and cuts. These can be injuries that will require immediate medical attention, surgeries, ongoing medical care, therapy and it will also mean loss of wages. This is an accident that can take months to heal from and one that the driver of the car is not usually at fault, but is still the injury victim.

Collisions between cars and trucks result in severe injuries in Redondo Beach and the truck accident victim can benefit by being represented by a truck accident attorney. This is an attorney that specializes in truck crashes; they have the resources to recreate the accident, thoroughly investigate the crash and to build a winning claim. This will mean that the driver and the truck company are held accountable legally for the crash and the injured victim will be awarded compensation by hiring personal injury lawyers like those at Ehline Law Firm PC at (424) 354-4027. This also sends a message to the truck company that they need to ensure their drivers have the proper training and experience to be on the roads with one of these multi ton vehicles and that they need to ensure that they do the proper maintenance. The truck companies that push the limit before they change brakes and tires on one of these big rigs are negligent when an accident is caused because of them. The truck accident attorney will use these types of facts when building their legal claim against the truck driver and company to ensure the injured victim recovers fair compensation.

The Link Between Divorce and Facebook

by ynhh-healthlibrary on April 2nd, 2011 at 10:22 pm

I just returned from Seattle, had to see my attorney there…Duncan says Facebook is not a major cause of divorce. It is, apparently, just a very convenient resource to accumulate evidence of infidelity, bad behavior, and poor judgment.

Also cited in the article was a press release from Chicago’s Loyola University that reportedly stated; “If you’re single, Facebook and other social networking sites can help you meet that special someone. However, for those in even the healthiest of marriages, improper use can quickly devolve into a marital disaster.”

I know I’ve been able to connect with people I went to high school with. I can see how a simple, “Hey, Susy, I see you’re on Facebook! How’ve you been all these years?”—could soon turn into—“You know Susy, my wife…” Of by the way if in Seattle this is a splendid Seattle divorce attorney who can help with family law and DUI in Bellevue as well as Seattle.

So much is made so easy with the Internet and sites like Facebook. It seems it’s even making it easier to destroy a relationship–as well as maintain and nurture them. It’s just a tool, I suppose, for good or for bad.
Bottom line, I’ve decided, is that using the Internet and social networking sites is just like anything else. If you are married or have committed yourself to a serious relationship, you would do well to behave accordingly—even when you think no one is watching.
